I understand and agree to comply with all applicable federal laws governing marketing and outreach, including the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act. I affirm that I will not engage in unauthorized phone calls, text messages, or emails in connection with my role. I acknowledge that such communications must follow legal requirements, including obtaining consent where required, honoring opt-out requests, and avoiding deceptive content. I accept responsibility for ensuring my actions align with these regulations and agree to indemnify the company against any violations resulting from my conduct.

Anti-Money Laundering & Know Your Customer Standards *

I acknowledge that, as part of my role, I may be exposed to sensitive client information and financial transactions. I understand and agree to comply with all applicable Anti-Money Laundering (AML) and Know Your Customer (KYC) regulations and internal policies. This includes accurately identifying clients, verifying their legitimacy, monitoring for unusual activity, and reporting any suspicious behavior. I recognize that these procedures are in place to help prevent fraud, identity theft, and other financial crimes, and I accept full responsibility for my compliance with these standards.

Client Information Confidentiality & Data Protection *

I understand and agree that all client information—whether current, prospective, or obtained through company resources—is strictly confidential and the exclusive property of the company. I affirm that I will not sell, share, transfer, or otherwise disclose any client data to third parties without prior written authorization. This obligation applies during and after the term of my engagement. I acknowledge that unauthorized use or distribution of client information may result in immediate termination and potential legal action.

Applicant Affirmation & Acceptance of Engagement Terms *

I affirm that all information I have provided in this application is true, accurate, and complete to the best of my knowledge. I understand that any misrepresentation or omission may result in disqualification or termination of engagement. I further acknowledge that I have reviewed, understand, and agree to the terms outlined in the company’s broker agreement or terms of engagement, including all associated compliance and conduct policies. By signing below, I accept these terms and confirm my commitment to fulfilling my responsibilities with integrity and professionalism.

Authorization for Background & Credit Checks *

I authorize the company and its designated agents to conduct background investigations and credit checks as part of the application and onboarding process, and at any time during my engagement if deemed necessary. I understand that these checks may include, but are not limited to, verification of identity, employment history, education, criminal records, creditworthiness, and references. I acknowledge that this information may be obtained from public records, consumer reporting agencies, and other lawful sources. I consent to the collection and use of this information in accordance with applicable laws, including the Fair Credit Reporting Act (FCRA), and understand that I have the right to request additional details or dispute any findings.

Independent Contractor Status Acknowledgment *

I acknowledge that I am being engaged as an independent contractor and not as an employee of the company. I understand that, as an independent contractor, I am solely responsible for my own taxes, insurance, licensing, and compliance with applicable laws. I will not be entitled to employee benefits such as health insurance, paid leave, or unemployment compensation. I further acknowledge that I have the autonomy to determine how and when I perform my services, subject to the terms of my agreement, and that I am not authorized to bind the company or represent it beyond the scope of my engagement.

Commission Structure Acknowledgment *

I acknowledge that my compensation under this engagement may be based in whole or in part on commissions. I understand and accept the terms of the commission structure as outlined by the company, including how commissions are calculated, when they are earned, and the conditions under which they are paid. I recognize that commissions may be contingent upon successful funding, client retention, or other performance criteria, and that no commission is guaranteed unless these conditions are met. I agree to abide by the company’s policies regarding commission reporting, disputes, and clawbacks, if applicable.

Non-Circumvention & Exclusivity Acknowledgment *

I acknowledge and agree that any clients, lenders, partners, or business opportunities introduced to me through the company are proprietary relationships of the company. I will not directly or indirectly solicit, engage, or conduct business with these parties outside of the company’s knowledge or consent, either during or after my engagement. I further agree not to represent or work with competing funding platforms or brokerages during any period of exclusivity defined by the company. I understand that these provisions are intended to protect the company’s business interests and that any violation may result in immediate termination and potential legal action.

Company Property & Tool Usage Acknowledgment *

I acknowledge that any materials, resources, documents, training content, or tools provided to me by the company—whether digital or physical—are the exclusive property of the company and are to be used solely for the purpose of fulfilling my responsibilities under this engagement. I agree not to copy, share, repurpose, or use these materials for any personal, commercial, or competitive purposes outside the scope of my authorized role. I understand that unauthorized use or distribution of company property may result in immediate termination and potential legal action.

Technology Access & Acceptable Use Acknowledgment *

I confirm that I have reliable access to the necessary technology required to fulfill my responsibilities under this engagement, including a functioning internet connection, a personal computer or laptop, and a valid email address. I understand that any systems, platforms, or tools provided by the company must be used solely for authorized business purposes and in accordance with applicable laws and company policies. I agree not to engage in any activity that could compromise the security, integrity, or performance of these systems, including unauthorized access, data sharing, or misuse of credentials. I acknowledge that failure to adhere to these guidelines may result in restricted access, termination of engagement, or legal consequences.

Consent to Electronic Communications & Document Handling *

I consent to receive, review, and sign all communications, notices, disclosures, and documents related to my application and engagement electronically. I understand that these materials may be delivered via email, secure portal, or other electronic means, and that I am responsible for maintaining access to the necessary technology to receive and retain such communications. I acknowledge that I may request paper copies at any time and that I may withdraw this consent by providing written notice, understanding that doing so may delay or impact the processing of my application or engagement. By providing this consent, I affirm that electronic delivery satisfies any legal requirement for written communication.
